Advert description
My insruction begins with a basic understanidn of how the system of the US common law, similar to the Great Britian comon law, with its US Constitution, statutes, and judge made case law, is different from the European Civil Law system with its code and judge's code interpretations. I then discuss how agency law, within areas of expertise, developed in the United States and the fundamentals of how agency law works with rule making procedures and its agency tribunals and appeals boards. I discuss the difference between criminal and civil law (as apposed to the civil law system mentioned above), the standards of proof (preponderance of the evidence and clear and convincing evidence in civil courts, and proof beyond a reasonable doubt in criminal courts) and standards of appellate review (clear error for findings of facts and substantial evidence on th record for errors in the understanding of the law). I then discuss the different procedures for representing clients in the boards and courts within the various legal subjectmatters. I then discuss the laws themselves and how courts declare the laws constitutional, follow clear laws, or declare them unclear and interpret and construe the laws.
